Terms and Conditions
Effective Date: 1st June 2026
Welcome to FORJD. By browsing our website, purchasing our crafts, commissioning bespoke work, or utilizing our "Back Door" Partner Portal, you agree to comply with and be bound by the following Terms and Conditions.
In these terms, "FORJD", "we", "us", or "our" refers to FORJD Ltd and the FORJD Foundation CIC. "You" or "your" refers to the customer, website visitor, or partner organization.
1. Our Craftsmanship and Products
Because our work is rooted in heritage craft, many of our items are handmade, hand-forged, or individually finished in our workshop.
-
Natural Variations: You acknowledge that handmade items, particularly those involving forged metals like copper and iron, may possess slight variations in texture, color, finish, and dimensions. These are not flaws; they are the unique characteristics of bespoke British craftsmanship.
-
Product Descriptions: We make every effort to display the colors and details of our products accurately on our website, but we cannot guarantee that your device’s screen will perfectly reflect the physical item.
2. Bespoke Commissions & Memorial Dedications
For custom orders, miniature sculptures, or engraved items (such as memorial leaves and plaques):
-
Accuracy of Information: You are entirely responsible for ensuring that all names, dates, and short phrases provided for engraving are spelled correctly. Once an item has been engraved based on the text you provided, we cannot offer corrections or refunds for customer errors.
-
Design Proofs: Where a design proof is supplied, work will not commence until you have given explicit, written approval. Any changes requested after approval may incur additional material and labor costs.
-
Legacy Projects: For memorial leaves attached to designated legacy trees, FORJD retains structural control over the maintenance, placement, and long-term care of the physical installation at our partner sites.
3. The "Back Door" Partner Portal (Hospices & Hospitals)
Our dedicated Partner Portal is designed to streamline orders for clinical and care teams.
-
Account Security: Authorized partners must keep their login credentials confidential. You agree to notify us immediately if you suspect any unauthorized access to the portal.
-
Order Responsibility: Orders placed through the portal by authorized staff are deemed valid requests. We will process these based on the dedication data provided via the portal forms.
4. Pricing and Payment
-
Currency and VAT: All prices are displayed in GBP (£). Where applicable, VAT or relevant taxes will be clearly itemized at checkout or on your invoice.
-
Payment Security: Payments must be made securely via our approved third-party payment gateways (e.g., via Wix checkout). We do not store raw card details.
-
Bespoke Deposits: Large-scale bespoke commissions may require a non-refundable deposit before materials are purchased and forging begins, as outlined in your individual project quotation.
5. Shipping, Delivery, and Installation
-
Lead Times: Because our products are handcrafted or custom-engraved, lead times can vary. We will provide an estimated completion or delivery timeframe upon order confirmation.
-
Delivery: We utilize trusted courier networks to deliver physical products. Risk of loss or damage transfers to you once the item is delivered to your designated address.
-
Memorial Installations: If your order involves a leaf or plaque intended for a physical memorial tree managed by FORJD, "delivery" is satisfied when the item is securely installed on-site. We will notify you once the installation is complete.
6. Cancellations, Returns, and Refunds
Your rights differ depending on whether you purchased a standard retail product or a custom piece, in line with the UK Consumer Rights Act 2015:
-
Standard Retail Items: For non-customized stock items (e.g., standard keyrings or unengraved items), you have the right to change your mind, cancel your order, and return the item within 14 days of receipt for a full refund. You must pay the return postage costs.
-
Custom & Bespoke Goods: Under UK law, the 14-day right to cancel does not apply to custom-made, personalized, or engraved items. Once forging or engraving has begun on a bespoke piece, the order cannot be cancelled, returned, or refunded unless the item is inherently faulty or a mistake was made by our forge.
7. Intellectual Property
The designs, sculptures, photographs, website content, logos, and specific concepts developed by FORJD (including our legacy project designs) are the intellectual property of FORJD Ltd and the FORJD Foundation CIC. You may not copy, reproduce, or commercially exploit our designs or content without our express written permission.
8. Limitation of Liability
While we build our physical works to endure, FORJD’s liability for any loss or damage arising from a breach of contract or negligence is strictly limited to the total purchase price of the order in question. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms excludes our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
